Standard Operating Procedure

Pursuant to New York Real Property Law Section 442-H, Upstate Down Properties LLC (“Upstate Down”) has adopted the following Standardized Operating Procedures (“SOPs”) that all real estate licensees associated with Upstate Down Properties LLC shall uniformly apply when working with prospective home buyers.

IDENTIFICATION
Upstate Down Properties LLC does not require prospective home buyers to provide identification as a condition of receiving brokerage services.
However, a seller may require identification as a condition of entering a property or attending a showing. In such cases, prospective buyers will be informed of the seller’s requirements before access to the property is granted.
EXCLUSIVE BUYER REPRESENTATION AGREEMENTS

Upstate Down Properties LLC does not require prospective home buyers to enter into an exclusive buyer representation agreement as a condition of receiving brokerage services.
A prospective buyer and an Upstate Down licensee may, however, mutually agree to enter into a buyer representation agreement at any time, subject to applicable law and regulations.

MORTGAGE PRE-APPROVAL OR PROOF OF FUNDS
Upstate Down Properties LLC does not require prospective home buyers to provide a mortgage pre-approval, proof of funds, or other financial documentation as a condition of receiving brokerage services.
However, sellers may require proof of mortgage pre-approval, proof of funds, or other evidence of financial qualification before permitting access to a property, scheduling a showing, or considering an offer. In such instances, prospective buyers will be informed of the seller’s requirements.

UNIFORM APPLICATION
These Standardized Operating Procedures shall be applied uniformly and consistently to all prospective home buyers in accordance with applicable federal, state, and local fair housing and anti-discrimination laws.
Nothing contained herein shall limit the ability of a seller to establish lawful requirements or conditions relating to access to a property or consideration of an offer to purchase.
